Terms and Conditions for Automated Digital Account Management Services (A.D.A.M.)


1. Acceptance of Terms
By accessing and using the website, services of Automated Digital Account Management Services (hereinafter referred to as "A.D.A.M."), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.


2. Communication and Marketing Opt-In

b. Types of Communication: These communications may include but are not limited to, emails, SMS messages, and phone calls.

c. Use of CRM Platform: A.D.A.M. utilizes the CRM platform for managing and delivering communications. Your data will be handled in accordance with both A.D.A.M.'s and the CRM’s privacy policies.

7. Disclaimer of Warranties
The services of A.D.A.M. are provided on an "as is" and "as available" basis. A.D.A.M. expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.


8. Limitation of Liability
A.D.A.M. shall not be liable for any indirect, incidental, special, consequential, or exemplary damages resulting from your use of our services.


9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which A.D.A.M. operates, without regard to its conflict of law provisions.

Automated Digital Account Management Services (A.D.A.M.) – Conditional Money-Back Guarantee

Introduction

This Conditional Money-Back Guarantee ("Guarantee") is provided by Automated Digital Account Management Services (referred to as "A.D.A.M.," "we," "us," or "our"). This Guarantee applies to clients ("you" or "Client") who engage A.D.A.M. for the setup, integration, and management of automated sales and reputation management systems using our proprietary A3 Sales System ("Services"). This Guarantee outlines the conditions under which Clients may be eligible for a refund of their initial investment in our Services.

30-Day Automation Accelerator – Guarantee and Terms

For the 30-Day Automation Accelerator, A.D.A.M. guarantees that your AI-powered automation system will be fully built, delivered, and functioning within 30 days, provided the following conditions are met:

Client Participation and Responsibility: You must complete the onboarding survey to provide necessary information. You are required to schedule and attend three (3) 30-minute setup calls and a final system review call to ensure we have what we need to build your automation systems. If you fail to provide necessary information, miss scheduled calls, or do not reschedule within the program period, this voids the refund guarantee.

Refund Conditions: If A.D.A.M. does not deliver the promised system in working order by the end of 30 days, despite your full compliance and participation, you may request a full refund of the Accelerator program fee. Failure to participate or provide necessary information within the 30-day window will render you ineligible for a refund.

Our Commitment: A.D.A.M. will make reasonable efforts, including reminders and follow-ups, to ensure your participation. However, non-participation or delays on your part are not grounds for a refund.

Annual Plan Refunds and Month-to-Month Services

Eligibility

Engagement Period: Clients must have engaged with the A3 Sales System continuously for one (1) year from the date of the initial agreement. Compliance: Full compliance with the implementation guidance, strategies, systems, coaching, support, training, courses, and tools provided by A.D.A.M. is required. Active Participation: Clients must actively participate in all offered support, course material, and training sessions, including but not limited to live chat support, one-on-one Zoom calls, and any other support resources provided by A.D.A.M. to its members.

Conditions for Refund Eligibility

Documentation of Efforts: Clients must provide comprehensive documentation of their use of the A3 Sales System, including logs of support interactions, attendance at training sessions, and any other relevant engagement with A.D.A.M.'s resources. Proof of Implementation: Clients must demonstrate that they have implemented the A3 Sales System according to the guidelines provided, without significant deviation. Attempt to Rectify: Before claiming a refund, Clients must have made a reasonable effort to rectify any issues through A.D.A.M.'s support channels.

Process for Claiming Refund

Notification: Clients must notify A.D.A.M. in writing within thirty (30) days following the one-year anniversary of the initial service engagement, expressing their intent to claim a refund under this Guarantee. Review Process: Upon receiving a refund claim, A.D.A.M. will initiate a review process, which may include requests for additional documentation or clarification from the Client. Refund Issuance: If the refund claim is approved, A.D.A.M. will issue a refund of the Client's initial investment within thirty (30) days of claim approval.

Limitations

Scope of Refund: This Guarantee covers only the initial investment in the Services and does not extend to additional costs incurred by the Client or any claimed lost profits. Exclusions: This Guarantee does not apply to Clients who have not adhered to the implementation and engagement requirements specified by A.D.A.M.

General Provisions

Modification: A.D.A.M. reserves the right to modify the terms of this Guarantee at any time. Such modifications will be effective immediately upon posting the revised terms unless otherwise specified. Governing Law: This Guarantee shall be governed by and construed in accordance with the laws of the jurisdiction in which A.D.A.M. operates, without giving effect to any principles of conflicts of law. Dispute Resolution: Any disputes arising under this Guarantee will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

By utilizing the Services provided by Automated Digital Account Management Services, you acknowledge that you have read, understood, and agreed to be bound by the terms of this Conditional Money-Back Guarantee.
